General terms & Conditions
Article 1 – Scope of application
Present General Terms and Sale Conditions are in force to all contracts concluded through Dock 79 website.
Being an agreement concluded with a customer, foregoing General Terms and Sale Conditions shall only be in force if it is a distance contract defined in the Article 77, §1, 1° of the 14 July 1991 Act on trade practices and consumer information and protection. Foregoing Same conditions are not accordingly in force if, during the pre-contractual phase, both Parties are led to meet in person.
Article 2 – Terms and Definitions

The purchaser is in fact a consumer as defined (in Article 1, 7° of 14 July 1991 law on trade practices and consumer information and protection) as any natural or legal person acquiring or using products or services executed by Belgium Cable Park for non-professional purposes.
Article 3 – Offer
The information detailing the products or services that can be purchased on the Dock 79 website constitutes an offer to sell. Unless expressly stated otherwise, the offer is nominative and valid for as long as it is present on the website. However, Dock 79 cannot be held liable for an offer that, for reasons beyond its control, contains errors. Dock 79 is not responsible for any information, prices or opening times that do not come from its official website. The management reserves the right to modify its prices at any time, without prejudice to the validity for visitors of tickets/season passes purchased prior to this modification. As far as possible, the management will keep visitors informed of any disruption to Park activities under its control, by regularly updating the Dock 79 website and its Facebook and Instagram pages. As the sole aim of this information campaign is to minimise any inconvenience to park users, it may in no way be interpreted as an agreement by the management to grant any price reduction on tickets/season passes & season tickets sold for disruptions that have not been mentioned by the park.
Article 4 – Agreement formation
The steps to follow to conclude the contract are as follows: “ticketing -> bookings or gift vouchers” Package & price: selection of the activity chosen, the product(s) or service(s), and the quantity required. Date & time: choose the date and time you would like the activity to take place (not always compulsory, depending on the activity) Your details: enter the details of the recipient of the order. Payment: selection of the method of payment authorised by STRIPE. Acceptance or refusal of payment by STRIPE. Following the payment process, the buyer receives a confirmation message from Dock 79 or a message inviting him/her to restart the payment procedure in the event of a problem.
Article 5 – Means of electronic evidence
Distance contracts through “Dock 79” website are concluded directly with the S.A. BELGIUM CABLE PARK. If the ticket purchaser is a customer as defined in the Economic Law Code, governed by Provisions of the mentioned Code.
In their / its relation context, Parties accept means of electronic evidence, such as e-mails and records in computer systems. The e-ticket is valid as long as the customer can provide with the code linked to his / her / its booking. The e-ticket is only valid on the date and under conditions stating on the ticket. The valid e-ticket for a specific period can only be used if the park is accessible on that day, within the limits allowed by its attendance.
Article 6 – Payment
The contract is considered to be concluded at the time of the payment acceptance by STRIPE. As the payment module is directly managed by STRIPE, none of the related to payment information is transmitted to Dock 79. The company declines all responsibility for the online payment process. In their / its relation context, Parties accept means of electronic evidence, such as e-mails and records in computer systems. According to the payment submission process, the buyer will receive a success message or a message inviting him / her to repeat the payment submission process in the event of problems. Belgium Cable Park declines all responsibility for the online payment related process.
Article 7 – Refund and postponement policy and Cancellation assurance
According to article VI. 53 12° of the Economic Law Code, the customer has no right to renounce his purchases, whether it is a dated ticket or not. However, Dock 79 has put in place restrictive conditions allowing the postponement or exchange of his purchase. Regardless of how they were purchased, tickets and deposits paid for reservations giving access to the park will not be refunded. Up to 5 days before the date of the reservation, dated tickets and reservations with a deposit can be postponed or exchanged for another activity, or for a voucher with a date of one year from the date of issue. The ticket must not have been used or can no longer be used by the purchaser, who must contact the Dock 79 by e-mail to express his or her request. After the contractual 5-day period, no ticket will be carried forward or exchanged. The only reasons for acceptance after this period are the following : illness or injury, proof of which is provided by a medical certificate valid only for the person concerned ; death of a relative, proof of which is provided by a death certificate. Please note that our activities can be enjoyed in all weathers. Rainy weather cannot be accepted as a valid reason for cancelling a booking. Only conditions likely to have an impact on the safety of participants may lead to the suspension or cancellation of an activity. These conditions are constantly assessed by our team of professionals.
Any unused or partially used ticket will not be reimbursed or exchanged and will not be eligible for a credit note (except on presentation of a medical certificate or death certificate), regardless of the period of validity of the said entry/reservation.
Gift vouchers and promotional codes are valid for a fixed period, established at the time of issue. The period of validity of the voucher/code may not be extended under any circumstances. The activity covered by a voucher/code cannot be exchanged for another activity.
In accordance with article VI.53, 12° CDE, the visitor does not benefit from the right of withdrawal for services relating to leisure activities, if the contract provides for a specific date or period of performance.
The Dock 79 offers its customers a cancellation insurance valid for one day. This insurance allows the holder to cancel the activity up to 24 hours before it takes place, at an additional cost of €5 per person, and to obtain a gift voucher (valid for 1 year) for the activity covered by this insurance (no refunds possible). Once the insurance has been taken out, it is non-refundable. When purchasing a multi-session card for one of our activities, the cancellation insurance cannot be taken out at the time of purchase of the card on our website, but only at the time of booking each session.
Article 8 – Delivery
Postal mailing is not in force to our products. Any product purchased on the Dock 79 website can be downloaded and printed at home.
Article 9 – Respect for Intellectual Property
The intellectual Property Rights of the site and its elements are belonging to Belgium Cable Park. The Sales Contract concluded between Dock 79 and the Buyer does not grant the right to copy, reproduce, download, post, transmit or distribute any elements of the Dock 79 park.
Article 10 – Privacy Policy
Rules concerning compliance with the legislation on the protection of personal data are described in the Privacy Policy. Dock 79 respects the Personal Data Protection in accordance with the Belgian and European regulations applicable to the Personal Data Protection, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the Individual Protection with regard to the Personal Data Processing and on the free movement of such data. Article 11 – Applicable law and competent court
Any Dock 79 related website and tickets’ dispute sale is governed by Belgian Law. Courts and tribunals of the district of Mons have exclusive jurisdiction. In the event of dispute, a printed version of the Foregoing General Terms and Sale Conditions and any appendices issued in electronic way will be accepted in any judicial, extra-judicial or administrative proceedings.
Article 12 – Good life and morals
Dock 79 reserves the right to expel or refuse access to visitors who display inappropriate behaviour (drunkenness, rude behaviour, failure to comply with the internal rules, vandalism, etc.). The latter may not claim any compensation or refund.
Article 13 – Insurance
The civil liability of the company Belgium Cable Park S.A (Dock79) covers damage to third parties when a fault, damage and a causal link between Dock79 and the customer/visitor are established. Apart from this causal link, it is the responsibility of each visitor, practitioner and client to verify that an individual accident insurance subscription has indeed been taken out on their own initiative
